Acceptable Use and Liability Policy

Scope and Acceptance

This document establishes the acceptable use conditions of the Wuaps platform, as well as the allocation of responsibilities between Wuaps and its users.

By accessing, registering, or using any feature of Wuaps, the user declares having read, understood, and fully accepted this Policy, together with the Terms and Conditions, Privacy Policy, Refund Policy, and other documents published at wuaps.com.

If the user acts on behalf of a company or organization, they declare having the necessary authorization to bind it to these conditions.

Permitted Use

Wuaps is designed to help businesses manage their communications through WhatsApp Business Platform (Cloud API) in a safe, responsible manner and in compliance with Meta's policies.

Users may use Wuaps exclusively for legitimate commercial purposes, including:

• Customer service and conversation management.
• Response automation through chatbots and user-configured flows.
• Sending notifications and campaigns authorized by WhatsApp Business Platform.
• Integrations with external systems via API.
• Use of artificial intelligence features available on the platform.

All use of the platform must comply with applicable law in the user's country or region, as well as Meta's and WhatsApp Business Platform's current policies.

Prohibited Use

The following uses of Wuaps are expressly prohibited:

• Sending unsolicited bulk messages (spam) or communications that do not have the recipient's consent.
• Distributing fraudulent, misleading, defamatory, or illegal content.
• Promoting unlawful, violent, or public order-threatening activities.
• Impersonating individuals, companies, or brands.
• Sending malware, malicious code, viruses, or links that compromise the security of third parties.
• Infringing intellectual property rights, privacy, or any other rights of third parties.
• Gaining unauthorized access to systems, accounts, or third-party data.
• Interfering with the operation of Wuaps, its servers, or other users' systems.
• Reselling, sublicensing, or transferring platform access to third parties without Wuaps' express written authorization.
• Violating the usage policies of Meta, WhatsApp Business Platform, or any other provider integrated into the platform.

Violation of any of these prohibitions may result in immediate suspension or cancellation of the account, without prejudice to any applicable legal action.

Use of Artificial Intelligence Features

Wuaps may include artificial intelligence-based features, such as conversation summaries, response suggestions, or other generative capabilities, provided by third parties such as OpenAI or equivalent providers.

The user acknowledges and agrees that:

• They are solely responsible for the content they review, edit, and send through these features.
• AI-generated content may contain inaccuracies and must be verified before use.
• Use of these features must comply with this Policy and the terms of use of the corresponding AI providers.

Wuaps assumes no responsibility for content produced through artificial intelligence tools, nor for decisions made by the user based on such content.

User Responsibility

The user assumes full responsibility for:

• The accuracy and currency of the information provided in their account.
• The confidentiality and security of their access credentials.
• The content of all messages, campaigns, and communications sent through the platform.
• Compliance with applicable law, including regulations on data protection and commercial communications.
• Obtaining prior consent from their contacts to receive communications via WhatsApp.
• Complying with Meta's and WhatsApp Business Platform's policies at all times.

Wuaps does not control or monitor the content sent by users and shall not be liable for damages resulting from misuse of the platform.

Wuaps' Responsibility

Wuaps provides a technology platform to facilitate the integration and management of WhatsApp Business Platform (Cloud API). Our commitment is to keep the platform available, secure, and continuously improving, providing technical support where appropriate.

Wuaps does not create, modify, or monitor the content sent by users through the platform.

Third-Party Services

The operation of certain Wuaps features depends on services provided by third parties, including Meta, WhatsApp Business Platform, Stripe, OpenAI, Google, and other technology providers.

Wuaps does not control, and therefore assumes no responsibility for, the decisions, changes, interruptions, limitations, or discontinuations that these providers make to their services. Changes implemented by third parties may affect the operation of certain platform features without constituting a breach on the part of Wuaps.

WhatsApp Business Platform and Meta's Decisions

The activation, review, approval, limitation, suspension, or blocking of accounts, phone numbers, message templates, and other resources associated with WhatsApp Business Platform are processes administered exclusively and at the sole discretion of Meta.

Wuaps does not participate in these processes and has no ability to influence, modify, or reverse decisions made by Meta. The user acknowledges this limitation and releases Wuaps from any liability arising from Meta's decisions regarding their account or WhatsApp Business Platform resources.

Limitation of Liability

Wuaps does not guarantee, and the user expressly acknowledges:

• The approval of accounts or message templates on WhatsApp Business Platform.
• The delivery of 100% of messages sent through the platform.
• The continuous and uninterrupted availability of integrated third-party services.
• The achievement of specific commercial results from the use of the platform.
• The compatibility of the platform with all of the user's internal processes.

To the maximum extent permitted by applicable law, Wuaps shall not be liable for direct or indirect losses, lost profits, data loss, business interruption, reputational harm, or any other damage resulting from: (i) decisions or actions of third-party providers; (ii) failures in third-party services; (iii) improper or unauthorized use of the platform by the user or third parties; or (iv) circumstances beyond Wuaps' reasonable control.

Consequences of Non-Compliance

Violation of this Policy may result, at Wuaps' sole discretion, in the following measures:

• Formal warning to the user.
• Temporary suspension of platform access.
• Permanent account cancellation without right to a refund.
• Reporting to the competent authorities in cases of illegal activity.

Wuaps reserves the right to take any of these measures immediately when the severity of the violation so requires, without prior notice and without prejudice to any applicable legal action.

Reporting Abuse

If you detect misuse of the platform by another user, or become aware of activities that violate this Policy, you may report it through the contact channels published at wuaps.com.

Wuaps will review each report received and take the measures it deems appropriate. Submission of a report does not guarantee the adoption of any specific measure, nor does it create an obligation to inform the reporting party of the actions taken.

Updates to This Policy

Wuaps may update this Acceptable Use and Liability Policy when necessary for legal, technical, or commercial reasons.

The current version will always be available at wuaps.com and will take effect from its publication date. Continued use of the platform after the publication of changes will constitute acceptance of the updated version.
